Terms and Conditions

1. Overview

This website is operated by OZV Homes (“we”, “us”, “our”). By accessing our website and/or placing an order, you agree to be bound by these Terms & Conditions, together with any policies referenced (including our Shipping & Returns Policy and Privacy Policy).

We may update these Terms from time to time. Your continued use of the website constitutes acceptance of any updates.

2. Price & Payment

2.1 Pricing

When you place an order, you agree to pay the Price and any applicable Delivery Fee (if charged).

All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable.

2.2 Price Changes & Errors

We may change prices at any time without notice.

If you have already placed an order at a specific price, we will supply at that price unless there is a pricing error.

If a pricing error occurs, we may cancel the order and refund any amounts paid, or contact you to confirm whether you wish to proceed at the corrected price.

2.3 Payment Methods

Accepted payment methods are displayed at checkout (e.g. credit/debit card, PayPal, and other payment options that may be available from time to time).

The name on the payment method should match the order name where possible.

Orders placed online must be paid via the available online payment methods. (If you have trade/account arrangements, these must be agreed in writing and may be handled separately.)

2.4 Payment Clearance

All payments must be successfully processed and cleared before goods are dispatched or released for pickup. If payment fails, the order may be rejected or cancelled.

2.5 Fraud & Compliance

By paying or attempting to pay, you confirm you are authorised to use the payment method and have not engaged in fraudulent conduct or breached any law.

3. Orders

3.1 Order Acceptance

Placing an order is an offer to purchase. We may accept, reject, or cancel an order at our discretion, including where:

stock is unavailable;

there is a pricing or listing error;

we suspect fraud or unauthorised activity; or

delivery is not feasible to the nominated address.

3.2 Product Information

We aim to display product images and specifications accurately, but:

colours may vary due to screen settings;

product specifications and dimensions may change due to manufacturer updates; and

you should rely on technical drawings and confirmed specifications for projects.

4. Dispatch & Delivery

Dispatch and delivery are governed by our Shipping & Returns Policy.

Risk in goods generally transfers to you upon delivery (including where “Authority to Leave” applies), unless otherwise required by Australian Consumer Law.

5. Cancellations / Order Changes

5.1 Before Dispatch

If you need to adjust or cancel an order, contact us as soon as possible. Where an item has already been allocated, packed, dispatched, or specifically ordered in for you, cancellation may not be possible.

5.2 Restocking / Handling Fee

Where cancellation is approved, a restocking/handling fee of up to 20% may apply, including (but not limited to) where:

the item was special ordered for your request;

the item has been allocated, picked, packed, or dispatched; or

the return requires additional handling/inspection/repackaging.

Any delivery fees already incurred are non-refundable unless required by law.

6. Returns & Exchanges

Returns and exchanges are governed by our Shipping & Returns Policy.

For change-of-mind returns (where accepted):

return shipping is the customer’s responsibility;

original shipping/handling fees are non-refundable; and

items must be unused, in original packaging, and in resalable condition.

We may refuse a return/exchange if items are used, installed, damaged, incomplete, or not returned in acceptable condition.

7. Damages, Defects & Incorrect Items

7.1 Inspection Timeframes

You must inspect your order as soon as reasonably possible after delivery. For any visible transit damage, defects, or incorrect items:

notify us within 24 hours of delivery, and

submit any claim within 7 days so we can assess and assist.

If items are stored without inspection and issues are reported later, available remedies may be limited.

7.2 No Liability After Installation

Trade personnel (installer/builder/plumber/cabinet maker) must inspect items prior to installation.
If a product is installed despite known or visible damage/defect, we are not responsible for replacement, removal, re-installation, labour, or associated costs, to the extent permitted by law.

8. Warranty & Australian Consumer Law

8.1 ACL

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You may also be entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

8.2 Manufacturer Warranties

Some products may come with manufacturer warranties. Warranty details (if any) will be stated on the product page or provided on request.

8.3 Warranty Exclusions (General)

To the extent permitted by law, warranties do not cover issues caused by:

misuse, abuse, negligence, accidental damage, or improper maintenance;

improper installation or non-compliant installation;

failure to inspect prior to installation;

exposure to corrosive environments (including saltwater) where not suitable;

harsh/abrasive cleaners, chemicals, adhesives or sealants damaging finishes;

modifications or alterations to the product; or

9. Limitation of Liability

To the maximum extent permitted by law:

we are not liable for indirect or consequential losses (including loss of profit, project delays, loss of opportunity);

where liability cannot be excluded, our liability is limited to the remedies available under Australian Consumer Law (e.g. repair, replacement, or refund, as applicable).
